I'm not really sure that you could call this a scam in the advanced fees sense of the word.

There are tons of these types of sites all over the net. The way that they usually work is that you pay your money and are then sent your product to sell on the Internet. The product that you are selling is basically an ebook that tells you to set up a site to sell the same ebook.

Dubious marketing and spamming yes, but I don't think you could get enough proof that this was fraudulent to get a host to shut the site down. Unless you paid for the product and they didn't send you anything.

The reason I think that it is not legit is that it spammed a forum. Do real sites advertise like that?

No, legitimate businesses wouldn't spam a forum, but then again can you prove without doubt that it was actually the business that was spamming the forum? It could be someone trying to cause them problems or possibly (if they utilise an affiliate marketing method) an affiliate trying to make money independently.

The way I see it there are 3 types of business.

Legitimate
Dodgy
Outright scam

This one would appear to fall into the dodgy category.

Unless you can prove that it is doing something illegal then you would get a host to close it down.

Moved to Misc. Scams from the fake bank forum. While certainly dodgy looking, it isn't advance fee fraud.
