Also the withdrawal slip of the funds from the bank is still with my client, accompanied with a copy of the death certificate which was issued when her father died, also note that her father was the one that withdrew the funds from the Sudanese Islamic bank and arranged for it to be transferred to the United Arab Emirate and deposited into a security vault with Deposit Company in the U.A.E before he passed away unfortunately.


My client wants her inheritance to be invested in your country as a future security for her self and her children and not to be collected by her husband by right of Islamic law has practiced in Saudi Arabia, this a brief of the situation.


For now I my company does not operate a website, so without any further delay I would appreciate if you could first of all send to me a very efficient profile of your self and the firm that you do represent, and also I will want you to send me a business plan on how you do envisage to invest my clients money in realty in your country.

Immediately I do receive this I would then forward it to my client for her consent. Africa. The company was originally founded in Europe (France I believe).

personally based in our San Francisco office in the United States of
America and I am not licensed in South Africa. However, I am licensed in
North and South America, including Canada and 4 countries in South
America.
As for investments in South Africa, I have a very good friend of mine

Thanks for your e-mail.
Right now I feel it is too early to be considering my traveling to the
U.A.E. At this point, I believe that it would be premature to make any
plans for such a trip. Perhaps as things develop a trip might be
warranted but for now, I would like things to get organized first.
The simplest and most expeditious way to transfer your client's funds
would be to open an investment account with a reputable firm in the
U.A.E or Saudi Arabia and instruct her broker to invest in the funds
I've mentioned in my previous e-mail. Since we are the underwriters for
these funds, your��client's broker would be dealing with me (the funds
being in North America) and your client would pay an initial fee to her
broker. This broker in turn, would pay a fee to me (roughly 1 to 2% of
gross proceeds) for my role as a broker this side of the investments.
By doing this, we would not be subject to the licensing rules that you
are aware of.

Hope this answers your and your client's questions.

Harold,

Again, on behalf of myself and my colleagues,��let me apologize for the
last incidents. No one saw it coming and it has caused all of us a few
moments of anxiety. Like I've mentioned before, the hacker was a
disgruntled ex-employee who was fired sometime in February but I don't
know all the details. I am using my own personal e-mail account at the
moment since our security team people are still going through all our
personal and corporate files and accounts. Even my boss's e-mail address
he and I were sharing (Gary Coleman) is shut down. The security team
needs to ascertain the damage done and this may take weeks. In the
meantime, please DO NOT use my old e-mail address (XXX@XXX or our corporate addresses XXXXd@XXXX and
XXXXX@XXXXX.
Let me assure you that we have the problem resolved, and we are now
cleaning up.��As you can see, we have made every effort to secure our
information and things should be back to normal by tomorrow. The person
in question was arrested later that same night and is now facing fraud
charges in the U.S. district court. He was not able to divert any funds
but did manage to fool many of our colleagues in the UK, Australia and
Malaysia who thought he was still working for us here in the U.S.

Hope this clarifies the situation for you. Again my sincere apologies
and I hope we can resume our business together as soon as tomorrow. As
mentioned before, we will be using my personal e-mail account until
further notice and things get back to a more normal state.

account in your bank. Thank you for your expedient reply.
I am sorry to learn that your website is down for maintenance.
Hopefully, this situation will not last to long.
I understand that you intend to send us the required forms in order to
open the bank account. Please forward these to us and we shall fill
them out immediately and return them to you as soon as possible:
However, I must point out that the amount requested as a minimal
deposit contravenes the agreed upon conventions of international
banking.
The World Trade Organization convention document on International
Banking of 1998 and the World Bank regulations clearly specify that no
funds shall be required by banking or lending institutions, financial
institutions or chartered banks as a minimal deposit for the opening of
a personal banking account. I further direct your attention to Article
107.b, para E, sub-paragraph ii, item 3c of the WTO amendment C6
(October, 2002) which states in part: " ...any and all banking or
financial institutions, chartered and registered in any sovereign
country shall, in respect to minimal deposit fees, forgo any and all
practices pertaining to such fees..."
In respect to foreign corporate accounts, I would also direct your
attention to the World Bank Directive 48119, Vol. II, Chapter 11,
Article 29 which states, in part:.." as to the extend of foreign
corporate accounts, only those companies registered with a national or
international body recognizing such a company as dully incorporated or
of limited liability, shall be authorized to pursue any banking business
in a foreign country, said country being sovereign and not submitted to
international banking regulation sanctions, United Nations sanctions or
civil war. In the event that a foreign company does conduct any form of
financial or banking affairs in said sovereign country, the banking
authority of that country may, at the discretion of its regulators and
to ensure that said financial affairs are of a reasonable duration and
benefit to the host country, authorize the setting of a benchmark for
the minimum deposit of funds in a foreign corporate account. In case of
the later, the funds required as a security or minimum deposit shall not
exceed the amount as set by the International Banking Regulations
(Gen�ve, 1999). This amount, as set by the International Banking
Regulations shall not exceed the amount of US$750.00 (U.S. Seven Hundred
and Fifty Dollars). Any liability, insurance costs, and associated
debentures, with the exception of administrative costs, shall be borne
by the financial institution in which the account is initialized... "
(Reference: World bank Directive 48119, Vol. II, chap. 11, article 29,
page 683)
Your country, the U.A.E, as well as mine, the United States of America,
are��signatory of these conventions and regulations and have ratified
them in 2001. I invite you to consult them.

I agree with your administrative charges which reflect the accepted
industry standard; we ask the same amount to our clients when they open
an investment portfolio with us. But as you can see, all other charges
exceed the amount authorized by law. In any event, I have sent a copy of
this message to my client and associate, Mr Harold Malik, and will be
contacting him shortly to get his opinion and that of his client.

Dear Harold,

This is a follow-up e-mail from the one I've sent to the bank yesterday
in which you were CC'd. I have received some correspondence from the
bank representative and am awaiting the initial bank account forms.
However, as investment and financial consultant to your client, I must
advise you and your client that I am not happy with the bank's approach
so far. Let me explain: On top of the administrative costs, which are
normals and par with the industry standard (we charge approximately the
same amount) the bank insisted on having us make a minimum $5,000
deposit to open the bank account. This practice, while not illegal, is
not common. However, the amount requested IS ILLEGAL and contravenes all
international banking laws and practices. I have included in my e-mail
to the bank representative, the appropriate articles listing the maximum
amount a bank can request and the reasons why.
I am ready to proceed forward with the investment plan you and your
client agreed upon. I would strongly suggest that you and/or your client
find another bank to do business with as this one seems a bit greedy.

Please let me know as soon as possible how you and your client wish to
proceed.

Sir,

I have forwarded the applicable World Trade Organization and World Bank
International Banking references and precedents concerning the MAXIMUM
amount of funds a bank or financial institution can request as a minimum
deposit for the opening of foreign accounts. I have indicated also that
the U.A.E have signed the applicable protocols and have ratified them.
It is not my problem, nor my clients problem if you have failed or are
too cavalier to look them up. The amount you are requesting contravenes
these laws and regulations. In other words sir, you are breaking your
country's own banking laws by demanding such an exorbitant amount. If
you persist in requesting that amount instead of the usual US$750
dollars standard fee, I have no choice��but to instruct both my clients,
Mr. Harold Malik and his client to look for another bank. Your
persistence in this matter is causing great distress and anxiety to both
my clients. I am ready to move on to the next phase of my clients
business, the fund transfers and investments and your irresponsible and
unprofessional conduct is impeding this process.

I do hope that you will abide by your own banking laws and will
reconsider.

At this point I'm not certain if the banker and Harry are one and the same. If he is, then he has to live through the insults I throw at the banker while keeping him informed. If not, then I'm certain that the banker was told to get with the program;observe Wink

So far this is were things stand. I've wasted 4 more days of the lads time claiming that the forms he sent me (as a fully editable MS word doc1) are corrupted and to send them again, all the while complaining to my client Harry and suggesting that he get another bank,MOre to follow shortly
