Ref. the possible excuses listed; are pictures or videos taken on a mobile phone time and date keyed? If so, then a check of the previous owner's calls should establish if he was using it to ring people before and after the porn images were recorded. And if he was... well...

I can't speak for videos, but with photos it very much depends on the phone. Some do and some don't.
