I'd say, if it's an image anyone can find in google images then I don't see a problem. If it's something they've personalized, you should definitely ask permission.

I snagged mine from Concepts College. Its a wonderful den of scammers ready to take anyones fees via Paypal. I guess by all rights you need to ask them first but the image that they are now using is really bad.
