A gentleman in that town sold 1 car to 4 people. He has promised to payback but never came through. I need someone's help in or near that area to find and "talk" to him. I will give you the whole story if you care to help. Anyone interested in seeing justice served?

The law said they had him. Then Mr Crook used the old trick of telling me he wanted to set up a "payment plan". He did send me $250. and no more. The police at that time said since I agreed to his plan, it was out iof their hands. My only contact with him was by e-mail and he was always promising to send more $. Now he won't reply to my e-mails.
The "talk" would be to scare him into continuing the payments. It would be best conducted in an alley with a stick. |

Sorry, Daleford, but you've come to the wrong place.
We deal with advance fee fraud and fake sites, not deadbeats. We also don't persuade people with sticks.
This is a matter for the police or small claims courts, not us. |

sounds like time for all affected buyers to either get together and file a joint lawsuit against the seller or for each to file their own in small claims.
Either way, depending on the laws in that area, you may be able to also get court fees and out of pocket misc expenses back as 'special damages' and may be able to get punitive damages (some areas allow punitive damages to be equal to 100% of claim, other areas allow 200% for punitive damages, etc)
Punitive damages are typically only awarded when there is gross negligence by a defendant, and i'd say selling the car 4x would qualify (but i'm not an attorney) |

see the Better Business Bureau(BBB) in the Salisbury,NC area. see the phone book for that area. also if it has to do with new or used car dealers then the auto dealers have an association in that area. if it is outright fraud,then the NC State AG ( attorney general office) should have a section that deals with that type of thing ( e.g. phony odometer settings,phony titles,etc). the AG office may also have a consumer fraud section that helps with things like "buying a lemon', etc or miscellaneous frauds on consumers. you may also witsh to contact Consumer Union ( magazine Consumer Reports,see the front of that magazine fior an 800 number to call and ask what to do) good hunting! |

Sorcerer. It WAS outright fraud and the detective told me that. Problem is the private individual/crook contacted me about a "repayment plan" and sent a small amount of money. One the detective heard that he said you and him have worked it out between you, we [the law]are not involved anymore. It is an old trick.
I will study the bad business bureau. Looking for a large man with a baseball bat at this point! |

much cheaper to simply file a lawsuit in small claims court. And, would be the legal way to deal with it. |

Yeah, I was just sounding tough.
The lawsuit is probably how I will go. However, I am 1200 miles away so would have to fit it in with next winter's trip to the south. This actually happened 2 years ago. Anyone know how much time I have to file suit. Also, I don't know which county he lives in anymore. problems? |
