BERLIN (Reuters) - A German father of five sentenced to jail for online fraud is protesting against his conviction by occupying the top of a 22 metre (72 foot) pole.

Fred Gregor, a 45-year-old lathe operator, has been squatting in a tiny cubicle atop the converted television mast since last Saturday morning in a bid to overturn the 15-month prison sentence he is due to start serving on March 1.

"I've been unfairly judged", he told Reuters from his perch in the village of Werben by telephone. "I want a new hearing."

In May 2006, a court in the eastern city of Dessau convicted Gregor after a man accused him of selling goods online that never arrived. The man told the court he tried to buy a laptop from Gregor but instead got a box filled with sand.

The court also found that Gregor's online business ventures were in breach of Germany's telecommunications law.

Gregor, who has a number of previous convictions, one of which involved setting up a Web site on which his wife stripped, said the judge at his trial was biased.

"He only based his decision on my past record," he said, adding that the judge had overseen all of his previous cases.

Since last weekend, Gregor said he had not left the rudimentary 3.25 square metre wooden box atop the pole, surviving on U.S. military surplus provisions and using a system of bags and pulleys as a toilet.

And his wife, 25-year-old Susanne Gregor, says she is very proud of him. "I'm backing him all the way," she said. "The children will know that their father stood up for what's right."

The unusual protest has attracted considerable attention from German media, and Gregor said he would not go quietly when authorities come to enforce his jail term.

"They'll have to come up here and get me," he said.

I didn't know being a complete <insert expletive of your choice> would be a good role model for a family, but hey I'm single, what do I know.

Incidentally if he doesn't come down before the sentance is due to start on March 1, could he be done for contempt of court and get an extended prison sentance?

I don't understand why he was'nt tacken straight to prisonj when he was sentenced. Sounds a bit odd allowing to go hope for a few weeks to plan a stunt like this.

^^^^ That's normal here. Except for hardened, dangerous criminals, most people sentenced to a prison term are given a date when they are expected to report to prison to start their term. 99,9% do.

The funniest way to catch him would be to bring in a crane, clamp it to the middle (slightly below), and then cut the bottom while hauling up on the crane, which would swing him down QUITE uncomfortably.

In reality though, if you have a crane there, you'd probly just lift up some officers in a basket, and let them have fun with him. (Safety harnesses for the officers, and handcuffs attached to the basket in case he tries to jump...

I would try a different approach:

- Set up some flood lights and make his life up there shining bright
- Get a few thousand Watt of amps and speakers and torture him with music 24/7. Just make sure it�s a kind of music he hates.
- Cut off the power to the pole
- Set up a fire hose and let it rain on his shed up there

I give him 24 hours before he gives up.

I don't get why you would want to get him down, I don't have any problem with him being up there for now. I'm sure he'll come down when he gets hungry.

why bother getting him down at all? put a cop on the base, a bit of barbed wire, and let him serve his sentence up the pole.

Actually not many here in GER are really interested in this moron. The pole is on his private property, so no one is really disturbed by him.

Just a desperate try to make some good press for himself - but he fails miserably.. Laughing
