<B><I>INTRODUCTION
The following is the actual email exchange between myself and a Nigerian “419” scammer who called himself “Chris Turner”. The scam works like this: the scammer targets attorneys and poses as a client who wants to collect from a customer who owes money. Once the attorney agrees to do the case on a contingency (usually at a rate higher than the standard contingency rate), the “client” sends the contact information so the attorney can send a demand letter to the debtor. The debtor, of course, is the same scammer under a different name who settles the case right away and sends a check to the attorney. The attorney then deposits the check, withdraws his retainer amount, and then forwards the rest on to his “client”, paying from his trust account. The check from the customer is a fake, of course, but by the time the attorney learns this, the “client” has already cashed the check from the trust account, leaving the attorney owing thousands of dollars. And, for some reason, Mr. "Turner" thinks I'm an attorney.

Unfortunately for Mr. “Turner”, I am familiar with how this scam plays out, and was ready and willing to beat him at his own game. What follows is the actual exchange between myself and Mr. Turner, with some of my commentary thrown in to help explain the less-than-obvious.

Enjoy!

Attention Counsel,

I have previously sent you an email;

Please confirm the receipt of this mail due to the urgency of this matter. If you are not in position to represent us at the moment kindly advice immediately. After a careful review,we decided to contact you to represent our company in North America and other parts of the United States.Shanghai MFC Import and Export Company is a manufacturing company with its head office in China, and branches all over Asia continent and Europe.

We got your contact details from your local States chamber of commerce. The management of MFC Import and Export Company requires your legal representation for our North American delinquent Customers. We are of the opinion that a reputable attorney is required to represent us in North America in order for us to recover monies due to our organization by overseas customers, and as well follow up with these accounts. In order to achieve these objectives a good and reputable law firm like yours will be required to handle this service. We understand that a proper Attorney Client agreement must be entered into by both parties.

This will be done immediately we receive your letter of acceptance.Attorney, you can advise us what is required to draw a proper letter of engagement that will be review by our board. We are most inclined to commence talks with you as soon as possible. We shall bring you into a detailed picture of what your responsibility is,when we receive your response.Your consideration of our request is highly anticipated, and we look forward to your prompt response to this request. Please contact me via Direct email: [email protected]

Your questions regarding this Proposal is welcome.Once more thank you for taking time from your busy Schedule to read this mail.

Mr. Turner:

I received your email this morning, and I apologize for not having received your previous email. We are currently in the process of moving our offices, and as such I have experienced some difficulty in getting communication.

While I am very flattered that I received such a referral from the Chamber of Commerce, you should know that I am assistant corporate counsel for Faux Holdings Corporation and as such, my main concern is representing our corporation's various branches in their business matters. Our senior attorney, Percival Mason, does allow me to deal with outside clients from time to time, but I have to obtain his approval first. You should also be aware that we are currently in the midst of negotiations in a matter for one of our global investments division, so I would not be able to begin work on anything new for the next couple of weeks.

If you are still interested, feel free to forward me additional information so that I can have some idea as to what kind of agreement I would need to draft.

Mr. Turner:

Thank you again for your reply. As I stated before, I will have to get
Mr. Mason's approval before I can take you on as a client so that we can
avoid conflicts of interest. I can provide you with a client
intake/conflict avoidance form if you would like. Mr. Mason will need to
see it before we can get started, of course.

I will also need some other information if I am to draft a
representation agreement. For instance, I need to know the size of the
sums that are involved and the locations of the customers who are
overdue on their payments. This will help me determine if I need to
charge an hourly fee, take the case on a retainer basis (and if so, for
how much), or take my compensation in smelmiarse fashion.

Please let me know when you have a chance.

Subject: Re: Mfc Imports & Exports(Legal Assistance)

Mr. Turner:

Assuming that Mr. Mason gives me approval to represent your company as
an outside client, I should be able to pursue all of these defendants
for payment. But, as I previously noted, I need to make sure that there
are no conflicts of interest involved before I can agree to represent
you. This is both an ethical requirement of the legal profession as well
as a requirement of the Faux Holdings legal department. Obviously, my
employer does not want there to be a situation in which I am
representing a client who is suing either my employer or one of its
customers. This would create a huge conflict of interest.

Therefore, before I can even discuss the terms of my retainer, I will
need you to complete the Conflict Avoidance Form. Would you like me to
send it to you as a PDF?

I sent you the Conflict Avoidance Form a few weeks ago, and have not heard back except from the message you sent saying you wanted it in Microsoft Word format. I responded, asking for clarification of what was wrong with the PDF since it seems clear on this end. Since then, I have heard nothing. As I indicated previously, I was working on a project for our Global Acquisitions division. This project is currently on hold while the documents are approved by the partners of both firms involved, so I can address your case now if you want to send me the forms.

Which, of course, it just might, given that I've disabled printing.

He apparently tries for a couple of weeks without any luck. Poor guy. But give him points for
persistence! He knows he's got me where he wants me, and he's not going to give up, so after
his couple of weeks, he decides that he's going to just bypass the whole bureaucractic process

Mr. Turner:

I am sorry to hear about the problems you are having. My guess would be that your computer has a virus of some sort on it because the form prints fine from my computer. You should have that checked out as soon as possible.

It is probably a good thing you were having trouble, anyway. I just learned from my secretary that a new form was approved a few months ago when our scanning software was updated and nobody had bothered to distribute it. If you had sent the old form in, it probably would have been rejected by the system and I would have had to send you the new one. But this form has some improvements. As you can see, you can now fax the completed form directly to my office number when it is completed. The system will automatically detect your call as an incoming fax and the computer will automatically scan it into the system. Since these forms are scanned, please make sure to follow the directions exactly. The computer doesn't cut anyone any smack.

I look forward to working with you once I have the forms in so that Mr. Perry can approve my representation of your company. Best success to you!

<I><B>
WHAT? You can't print it? Why oh why could that be? I mean, it prints fine on my end! (Of
course, I have the original version without printing disabled . . . )

Must be a virus on your end. Better get some of that expensive antivirus software and throw it
on your computer.

But, hey, lucky him! There's a NEW form now! And the best part is: this one's even LONGER! And
has some BETTER questions! And he can fax this one to me directly, which is what I really want
him to do since it will be an international fax and will cost him several dollars per page, which is
a lot of money for him to waste. (I figure every dollar he wastes on me is a dollar he's not spending
on someone who he's truly scamming.) Plus, I get what every scam baiter wants: a trophy!

So, I dutifully attach the form (again). You can see the pages here:

Well, at least he sent it. I mean, he was supposed to FAX it and he EMAILED it instead, but
maybe that'll be okay with our Conflicts Resolution people. Of course, they were awfully
faint and very low-resolution, so I don't even know if they'll be able to read it . . .

But he IS getting impatient, isn't he? And I thought his deadbeat customers were in Minnesota
and Arizona! (See his messages from May and June.) How does he stay in business with all of
these companies everywhere not paying up!

Mr. Turner:

The number is on the form. It is the same as my office number: 206-XXX-XXXX. The system automatically detects incoming faxes and sends them to the computer, where the voice mail system can accept the fax transmission. Please make sure you follow the PITA procedures exactly.

Holy cow, Mr. Ants-in-the-Pants! It's only been a couple of days! It took--what?--two weeks for
Ms. Payne-Diaz to get back to me last time. Chillax, bro! I'll just wait a little while before I
respond. You know: to give you time to relax a little.

But, as it happens, he DID fax the form back!

I mean, he KINDA faxed it back. I mean, it's pretty illegible and distorted, and most of the pages are either blank or simply not there, but it's (kinda) there. And he did send each page as a separate fax transmission, meaning it was even more expensive for him. Gotta love that.

And, of course, he didn't follow ANY of the instructions as to format, color, or anything like that.

But, fortunately, they're a forgiving bunch at Conflict Resolution . . .

Mr. Turner:

Sorry to take so long to get back to you. I went on holiday for a few days. Have you ever been to Tatooine? Because if you haven't, don't believe what the travel brochures tell you. It's not all casinos and cantinas; I've never visited such a wretched hive of scum and villainy.

Upon my return from holiday, I did find that I had received a fax that appears to be from you. However, it did not come through correctly and you will need to re-send it. (See the attached PDF.)

Thank you for your patience.

Okay, so I stole the reference to Tatooine from another scambaiter. But I figure, imitation is the highest form of flattery.

Anyway, I forwarded a copy of his fax back to him so he could see how badly he got ripped off by the fax service.

He was a bit crestfallen, but still willing to do what it takes to collect his money!

It appears he's had enough of me and decided to look for new counsel. And decided that the
new attorney should be . . . well, me. I did try to respond, but both this email address and his
old one were disabled. A pity. I never got to collect from his clients in Minnesota. I mean Arizona.
I mean California. Well, wherever they are, I hope they're doing well.

Oh, and that Mr. Turner has had a chance to vacation in Tatooine.

Very nice! I also thought "smelmiarse" was a nice touch. It's always good to add new words and expressions to the lads' vocabulary! Unfortunately, if you Google it, it points right back to this thread.

Yeah, I probably won't use that term again. Maybe a derivative, like "stinkifinners" or something.

Currently have a lad half-convinced he's stumbled onto someone smuggling arms to the former Libyan government. I'll post that one when it's run its course. (I thought I would have lost him long before now. I'm surprised he's taken the bait for so long!)

Fortunately, Lads usually lack the intelligence or the work ethic to do fact checking.
